Definition
We understand that Informed consent often refers to consent to a medical procedure after the patient has been made aware of all the risks and consequences. The basic requirements needed to be valid are freedom of choice, ability for decision and sufficient information to decide. It is recorded that there was informed consent by signing an informed consent document that includes the prior responsibility to properly information.
THE RIGHT TO INFORMATION
El artículo 23.1 de la Constitución española de 1978 establece que el ciudadano titular tiene derecho a ser informado para poder participar en la toma de decisiones en materia de salud pública.
La Ley General de Sanidad (Ley 14/1986, de 25 de abril) establece que el paciente tiene derecho:
- Art. 10.5 "A que se le dé en términos comprensibles, a él y a sus familiares o allegados, información completa y continuada, verbal y escrita, sobre su proceso, incluyendo diagnóstico, pronóstico y alternativas de tratamiento".

- Art. 10.6 "A la libre elección entre las opciones que le presente el responsable médico de su caso, siendo necesario el previo consentimiento escrito del usuario para la realización de cualquier intervención, excepto en los casos siguientes:
- Cuando la no intervención suponga un riesgo para la salud pública.
- Cuando no esté capacitado para tomar decisiones; en este caso, el derecho corresponderá a sus familiares o personas próximas.
- Cuando la urgencia no permita demoras porque puede ocasionar lesiones irreversibles o puede existir riesgo de muerte".
EL DOCUMENTO DE CONSENTIMIENTO INFORMADO
El Consejo Interterritorial del Sistema Nacional de Salud, en su sesión de 6 de noviembre de 1995, acordó que "En todo documento escrito específico de consentimiento informado deben figurar los siguientes apartados, enunciados de forma breve y en lenguaje comprensible, de manera que los conceptos médicos puedan entenderse por la generalidad de los usuarios:
- Personal data of the patient
- Name of doctor who reportedly not necessarily be the same as performing the procedure in which consent
- Name of procedure to be performed, with brief and simple explanation of the purpose of the procedure, what is it and how they will perform
- Description of the consequences of the intervention safe, to be considered relevant or important, for example, the loss of a limb
- Description of the typical risks of the procedure. Such means those whose performance must be expected in normal conditions, according to the experience and the current state of science. It also includes those who, being rare but not exceptional, are considered very serious clinic
- Personalized description of the risks. Be understood by those who are related to patients' personal circumstances and refer to the previous state of health, age, profession, beliefs, values and attitudes of patients, or any other circumstance of a similar nature
- At the discretion of the physician may include information that refers to the discomfort of the procedure and its likely consequences
- Declaration of the patient having received information about the extremes indicated in previous sections, as well as alternatives to the procedure, with pros and cons, so that the patient involved, if you want, choosing the most appropriate and that this choice takes into account their preferences
- Patient demonstration proving to be satisfied with the information received and to have obtained information on the questions raised and the possibility to revoke at any time informed consent, without explanation, and the expression of consent to undergo the procedure
- Date and signatures of the physician and patient information
- Section for consent through the legal representative in case of incapacity of the patient
- Section for the withdrawal of consent, which shall appear on the document itself
